Terms and Conditions
All machines are offered “as is, where is, condition, with any and all faults and with no guarantee or
warranty, whatsoever. There are no exceptions to this rule, regardless of age of item, usage, hours and/or
reported condition. Specifications, sizes, capacities and condition is to be verified by the bidder previous
to
bidding on the machine.
The Machine: The buyer acknowledges and agrees that
Machinery Associates Inc is simply a marketplace for machines. Machinery Associates Inc. is not responsible for
inexact machinery specifications, listed machinery data or condition. THIS MUST BE VERIFIED BY BIDDER PRIOR TO
BIDDING. Machinery Associates is not responsible for any discrepancies.
Buyer
Responsibility: Buyer is responsible for understanding how Machinery Associates Inc. (Machine
website)
works, Buyer is encouraged to read our Bidding Tutorial. For any questions, please call Machinery Associates at

To BID: Bidders/Buyers
are
responsible for registering and creating an account. In order to bid on Machinery Associates Auctions, You MUST
have
a verified account (requires Credit Card or Paypal account). All users are free to browse our Machine site and
view
any item. You must however, register an account (confirm identity) in order to bid on auctions. All users who
register for an account must provide their legal information, such as first and last name, company name (if
applicable), full address, phone number, credit card information, and any other information that may be
requested
and/or required upon registration for Auctions at Machinery Associates Inc.
Machine Specific
Terms: Each online Machine has its own set of Machine specific terms, these terms overrule this
terms
and conditions stated in this document. Upon registration a user agrees to both accept any and all terms and
conditions, including Machine specific terms. Upon registration and bidding on a Lot up for Machine, user/bidder
agrees to the main terms and conditions as well as the Machine specific terms and conditions.
Currency:
Machinery Associates Auctions use United States Currency Only.
Inspections: Machinery
Associates Inc. will provide as much information as seller provides for inspections. Details will be listed and
Machinery Associates is not responsible for any missing or incorrect inspection details. Buyer may contact
Machinery
Associates Auctions for more information on inspections.
Buyers Premium: The buyer's
premium is listed as a percentage (%) on each individual Machine listing and by submitting a bid, the
buyer/bidder
is acknowledging and agreeing to pay this buyers premium fee at the end of the Machine. All payments are to be
made
in (USD), United States Currency, only!
Your Bid: Your bid is a contract. Your bid is
not
retractable for any reason. Any bid that is the highest bid at the close of any Machine, leaves that bid as the
winning bid and the user associated with bid is responsible for purchasing the won item.
Machine
Watch: The Machine Watch is a list where you can find every item that you've shown interest in,
whether
it be a machine you've decided to watch, or a machine you've placed a bid on. The convenience of this list will
be
that it easily keeps you up to date on particular interests Machine Closings Each Machine has
it's
own closing time . Immediately after the machine has closed, there will be a system generated invoice sent to
the winners email. The winner will be responsible for making payment within 48hrs.
Time
extension; If an Machine is within five minutes (or less) of closing, and someone makes a bid, that
Machine closing timer will then be reset to five minutes remaining. It will never reset longer than 5 minutes
remaining. At the close of an Machine, the highest bid (above the reserve price) will be the winning bid. The
winner
will be notified via email, or text message determined based on the users preferences in their personal account
page
on Machinery Associates Auctions.
Reserve Price: "Reserves" are a price at which the
seller says he will not sell the machine. Once the reserve is met, the item will be sold at the highest bid. Any
item that has a "Reserve Met" will be listed as
such,
will be highlighted with green, while “Reserve Not
Met" will be highlighted with red.
Any
item where the reserve price has not been met by the closing date and time of that item, shall remain unsold and
all
bids will be null and void. You can contact the Machine Manager after close of Machine if you still have
interest in
purchasing the item.
Bidding: All Bids are a contract. All bids are set to a
specific,
minimum increment that cannot be changed during the bidding process. If, for example, a bid increment is set to
$100, then a user may only bid $100 increments. If at any time a high bidder is outbid, an email will be sent
out to
the user who has been outbid. this notice will contain an outbid notice and will provide a link to the machine
that
was outbid. If at any time a bidder submits a maximum bid and the user is outbid instantly, the bid will go up
to
the highest provided bid and an email with the outbid notification will be sent to the user. Machinery
Associates is
NOT responsible for any outbid emails not received.
Notifications: All registered
users
agree that Machinery Associates may send emails for the following reasons: Outbid Notification, Watch List,
Closings, Up Coming Events, Etc. If at any time a notification is not received, such as an outbid notification,
the
user cannot hold Machinery Associates responsible for not receiving the notification under any
circumstances.
Shipping and pickup: Shipping and pickup of any equipment won by the
user
is the sole responsibility of the user. Machinery Associates is not responsible for preparing or providing any
accommodations for shipping or pickup. Buyer agrees to arrange pickup or shipment of any successful purchase
after
payment has been received.
Unsuccessful bidding, lost auctions and outbids: The buyer
agrees that Machinery Associates is not responsible and cannot be held responsible for any outbids, lost
auctions or
failed attempts at bidding. The site: In the case of Machinery Associates Auctions availability, if at any point
Machinery Associates Auctions becomes unavailable, malfunctions, or in the event of any technical issues,
Machinery
Associates is not responsible for any potential damages and the buyer shall agree to this by using Machinery
Associates Auctions. Machinery Associates Auctions is not responsible for any emails sent from our site
containing
any information such as outbid notifications.
Resolution of Disputes
All
Business Transactions under this Agreement shall be governed and construed in accordance with the laws of the
State
of NH without regard to principles of conflicts of laws. The Parties irrevocably submit to the jurisdiction of
the
Hillsborough County, New Hampshire for the purpose of any suit, action or other proceeding arising out of
this
Agreement. The Parties, furthermore, waive any right it may have to a trial by jury in respect of any claim
brought
by or on behalf of either party based upon, arising out of or in connection with this Agreement.
